    Advanced Fraudulent Transfers: A Baker’s Dozen of Helpful Tips and Insights

    We all deal with fraudulent transfers, but sometimes issues that don’t come up in routine fraudulent-transfer cases might get overlooked. Do insurance policies cover fraudulent-transfer claims? Can a group of fraudulent-transfer plaintiffs assert a class action against a defendant? In terms of an actual fraud fraudulent transfer, what if a defendant has a mixed intent, part of which is impermissible and part of which is permissible? When can a fraudulent-transfer defendant use the “identity of interest” and “common enterprise” defenses? How can unjust enrichment be used as an alternative to a fraudulent transfer? How do the events of the past three years impact valuations, solvency opinions and fairness opinions prepared during that time and today?     This panel will provide an overview of the consumer fintech industry, focusing on such topics as how consumers are using fintech in banking, lending and investing; the growth of nonbank financial companies in the consumer market; how nonbank lenders are regulated; and what risks consumers face.     Consumer: Post-Petition Issues in Consumer Cases: Life Goes On

    Debtors’ lives don’t stop once a chapter 13 is filed. Jobs could be changed or lost, property can be sold and inherited, and debtors can become injured and can sue. Debtor's counsel has to know how to “roll with the punches” and still achieve the best outcome for their client. This panel will discuss the impact of foreseen and unforeseen events in a chapter 13 case. Who gets the benefit of equity in a debtor’s home if it is sold and has appreciated since filing? What if the case converts to chapter 7? What assets are included in the chapter 7 estate upon conversion? Does a debtor have a duty to disclose a post-petition asset such as a cause of action or inheritance? How does debtor’s counsel get paid to deal with all of these issues? Is a chapter 13 trustee entitled to be paid if a case is dismissed before confirmation? What are the requirements to modify what is paid in a chapter 13 plan?

ABI DEFINES A “GUEST” AS A SPOUSE, CHILD OR COMPANION — NOT A PROFESSIONAL COLLEAGUE. A professional colleague is defined as someone who consults with or is employed by an organization whose members are eligible for ABI membership. If a professional colleague is found to be registered as a guest, ABI reserves the right to cancel his or her event registration. Any person not meeting the criteria of “guest” who wishes to participate in any ABI function at the conference is required to register separately at the full conference rate.

Cancellation Policy

All fees, except a $75 handling fee, will be refunded if written notice of cancellation is received by June 24, 2022. No refunds will be granted after June 24, but substitutions will be allowed. After June 24, upon written request, a coupon for 20% off the registration fee (not including optional events) will be issued, which can be used (by the canceling registrant only) for any ABI educational program up to one year after this conference, or for this same conference next year.

ABI’s COVID-19 Policy

As the COVID-19 landscape continues to evolve, so too must ABI’s safety policies for in-person events. ABI’s priority for all conferences and events is the safety and welfare of our attendees, partners and team. For the ABI Events, we may require that in-person attendees show proof of a negative COVID-19 test taken no more than two days (48 hours) prior to arrival. In lieu of testing, attendees can upload their vaccination card to show that they are fully vaccinated against COVID-19 (as defined by the CDC) in order to gain admittance to the program. This decision was made in consultation with ABI leadership and is based on guidance issued by the federal Centers for Disease Control and Prevention (CDC) and other public health authorities. It is also consistent with the policies of many of our member firms and other associations nationwide.

Nestled at the edge of a 13-mile beach along the Atlantic Ocean, this resort offers beachfront horseback riding, wave-runners, ocean kayaks, indoor and outdoor pools, whirlpools and spa service, as well as golf and tennis. ABI has arranged a special conference rate of $359 single/double per night for Coastal View rooms. A limited number of Oceanfront Suites and Club Coastal rooms are also available to conference attendees at a rate of $469 per night (Oceanfront Suite) and $599 per night (Club Coastal). Ritz Kids®

The Ritz-Carlton, Amelia Island offers the Ritz Kids® program, an exclusive supervised children’s program designed specifically for children ages 5-12. The Ritz Kids® program allows parents to play while children stay with trained and certified counselors. Each counselor is certified in infant, child and adult CPR, basic first aid and water safety. The staff takes extra care to ensure that each child enjoys a positive, rewarding experience in the Ritz Kids® program. The Full-Day Program takes place Thursday through Saturday from 9:00 a.m.-4:00 p.m. and includes juice, snacks and lunch. The program fee is $175 per child. The Half-Day Program includes juice and snacks and is available Thursday through Sunday mornings from 9:00 a.m.-12 noon and Thursday through Saturday afternoons from 1:00-4:00 p.m. The half-day program fee is $100 per child. An optional lunch may be included for an additional fee. 24-hour advance reservations are requested. Continuing Education Credit*

12 hours of CLE credit, including 1.5 hours of ethics, are pending in states calculating CLE on a 60-minute hour, and 14.4 hours of CLE credit, including 1.8 hours of ethics, are pending in 50-minute-hour states. Credit hours granted are subject to each state’s CLE credit-approval regulations and might not be approved prior to the program. NY MCLE: This transitional and non-transitional program has been approved in accordance with the requirements of the CLE Board for a maximum of 14 credit hours, of which 1.5 hours of credit can be applied toward the ethics professionalism requirement. California MCLE: ABI certifies that this activity has been approved for MCLE credit in the amount of 12 hours, of which 1.5 hours will apply to ethics.

14 hours of CPE credit, including 1.5 hours of ethics, are also available.

* ABI offers intermediate-level courses, which assume that attendees will have at least some detailed knowledge of insolvency matters (pursuant to the “Statement on Standards for CPE Programs” established by AICPA and NASBA). ABI is registered with the National Association of State Boards of Accountancy (NASBA) as a sponsor of continuing professional education on the National Registry of CPE sponsors. State boards of accountancy have the final authority on the acceptance of individual courses for CPE credit. Complaints regarding registered sponsors may be submitted to the National Registry of CPE Sponsors through its website, www.nasbaregistry.org. ABI acknowledges that in some instances there will be persons who need to attend an educational seminar for CLE credit who are not able to pay full registration fees. ABI will handle such instances on a case-by-case basis and will work with the individual on alternative solutions. For persons who cannot meet the full registration rate, ABI will offer a reduced rate based on what the individual can reasonably afford to cover the cost of meals and materials. For persons unable to pay a reduced rate, ABI may allow the individual to work at the registration area for a few hours during attendee check-in, or assist in conference set-up. ABI also has reduced rates for government employees, professors, law clerks and students. Financial assistance is available for this program. Illinois Attorneys: If registration fees are more than $500, attorneys who qualify will receive at least 50% reduction in the registration fee.
